1. Acceptance of Terms

By creating an account or using FamilyPlate, you confirm that:

• You are at least 18 years old.
• You have the legal capacity to enter into these Terms.
• You will comply with all applicable laws and regulations.
• All information you provide is accurate and up-to-date.

2. Description of Service

FamilyPlate is an AI-powered meal planning platform that:

• Generates personalized weekly meal plans based on your family's preferences.
• Allows family members to vote on meals.
• Provides shopping lists and recipes.
• Supports dietary restrictions and allergies.
• Offers meal regeneration and substitution features.

BETA Status: FamilyPlate is currently in BETA testing. Features may change, and the Service may experience interruptions or errors.

3. User Accounts

3.1 Account Creation

To use FamilyPlate, you must create an account using a valid email address. We use magic link authentication—no password is required.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your email account.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized access.

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Subscriptions and Billing

4.1 Free and Premium Tiers

FamilyPlate offers a free tier and a Premium subscription tier with the additional features displayed in the Service and at checkout. Direct ordering through grocery delivery providers is not currently available.

4.2 Payment Processing

Payments are processed by Stripe. Before you subscribe, checkout shows the applicable price, currency, billing interval, and any trial. By subscribing, you authorize recurring charges at the displayed interval while your subscription remains active.

4.3 Auto-Renewal and Cancellation

A subscription renews at the interval shown at checkout unless you cancel before the next renewal. You can manage or cancel it through the billing link in your account settings. Stripe will show when the cancellation takes effect and whether Premium access continues through the end of the current billing period.

4.4 Refund Policy

Except as required by applicable law, all fees are non-refundable. We do not provide refunds or credits for partially used billing periods.

5. Grocery Services and Affiliate Links

FamilyPlate currently provides shopping lists for you to use with a grocery provider of your choice. Direct grocery-ordering integrations and affiliate links are not currently available in the Service. If this changes, we will identify any paid or commission-based link before you use it.

6. Content and Intellectual Property

6.1 Our Content

FamilyPlate content, including meal plans, recipes, shopping lists, and AI-generated recommendations, is protected by copyright and may not be republished or redistributed commercially without permission from the relevant rights holder, except as permitted by law.

6.2 Your Content

You retain ownership of any content you provide (e.g., preferences, votes). By using the Service, you grant us a license to process that content as needed to provide and maintain the Service. Optional public sharing is controlled separately in Preferences, as described in the Privacy Policy.

7. Disclaimers and Limitations of Liability

7.1 No Medical or Nutritional Advice

FamilyPlate is NOT a substitute for professional medical or nutritional advice. We do not provide medical guidance. If you have allergies, dietary restrictions, or health conditions, consult a healthcare professional before following any meal plan.

7.2 Limitation of Liability

To the fullest extent permitted by applicable law, BTW Marketing shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the Service. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Any other limitation of liability applies only to the extent permitted by applicable law.

8. App Store and Google Play Guidelines

If you download the FamilyPlate app from the Apple App Store or Google Play Store, these Terms are between you and BTW Marketing, not Apple Inc. or Google LLC. Apple and Google are not responsible for the Service, its content, or any maintenance and support services, except as required by applicable law or the relevant store terms.

9. Governing Law and Dispute Resolution

These Terms are governed by Swiss law, subject to any mandatory consumer protections and jurisdiction rules that apply in your place of residence. Please contact us first so that we can try to resolve a concern directly.
